Chairman Solmes called the regular meeting of the Barry County Road Commission to order at the Road Commission’s Board Room at 7:30 A.M.

 

Members present:  Solmes, Fiala, James, and Managing Director Jake Welch.

 

The agenda for May 21, 2024 was approved.

The ASMCRA Ballot to dissolve the ASMCRA and what should be done with the account balance of $21,515.00 if it is dissolved was discussed and decided on.

The 2023 TAMC Road Ratings was discussed.  Barry County has 40.7% Good Roads, 58.0% Fair Roads, and 1.3% Poor Roads.  BCRC is rated #12 out of 83 in largest percentage of Good Ranking and #1 out of 83 for least percentage of Poor Ranking.

At the Township of Barry regular meeting held on May 14, 2024 the following Resolution was adopted.

 

There came before the board the following matter:

 

Now THEREFORE BE IT RESOLVED that the Township of Barry hereby agrees to the following:

 

Road work for the following road:  Brooklodge Road Sheffield to Hickory Road:  $31,900.00

 

Payment plan of $80,000.00 2024-2025

 

 

 

 

 

 

 

 

 

 

 

Motion was made by Commissioners Fiala and seconded to request reimbursement in the amount of $10,000.00 for payment made during the period of July 1, 2023 through June 30, 2024 to a licensed professional engineer employed by this Commission, in accordance with Sec. 12(2) of Act 51.

WHEREAS, the Township Board of the Township of Prairieville, Barry County, Michigan, after due and legal notice, has conducted a public hearing upon a proposed assessment roll prepared under the direction of the Supervisor and Assessing Officer of the Township for the purpose of defraying the costs of a road paving project, along with associated activates such as, but not limited to, grading and drainage work, proposed to be undertaken within the BAYVIEW ROAD IMPROVEMENT SPECIAL ASSESSMENT DISTRICT NO 2023-1 as shown on the plans and specifications for such project; and

 

WHEREAS, such public hearing was preceded by proper notice in the Hastings Banner, a newspaper of general circulation in the township, and by First Class Mail notice to each property owner of record within said District and upon said assessment roll; and

 

WHEREAS, comments were received from those present as such public hearing concerning said assessment roll and opportunity given to all present to be heard in the matter; and

 

WHEREAS, a record of those present to protest, and of written protests submitted at or before the public hearing was made a part of the minutes of the meeting; and

 

WHEREAS, the Township Board has duly inspected the proposed assessment roll and considered all comments and proposed amendments thereto and has found the proposed assessment roll, as amended, to be correct, just and reasonable.

 

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

 

The assessment roll a prepared at the direction of the Supervisor and Assessing Office of the Township, as amended, shall hereafter be designated as the BAYVIEW ROAD IMPROVEMENT PROJECT SPECIAL ASSESSMENT DISTRICT NO. 2023-1 and shall hereby be confirmed as the assessment roll for BAYVIEW ROAD IMPROVEMENT PROJECT SPECIAL ASSESSMENT DISTRICT NO. 2023-1 in the amount of one hundred twenty-one thousand one hundred thirty one dollars ($121,131), which is the amount proposed to be raised by special assessment.  The proposed assessment against each property in the district will be approximately $504.71 per year, for 10 years (2024-2033 inclusive).

 

The assessments in said BAYVIEW ROAD IMPROVEMENT PROJECT SPECIAL ASSESSMENT DISTRICT NO. 2023-1 ROLL shall be divided into ten (10) annual installments of principal as described in the Roll with the first installment to be paid with the Winter 2024 tax bill, which will be due and payable before the end of February 2025, and the following installments to be due in the same manner every year thereafter together with interest of 3% annually on unpaid principal.

 

Future due installments of an assessment against any parcel of land may be paid to the Township Treasurer at any time in full.  If any installment of a special assessment is not paid when due, then the installment shall be considered to be delinquent and there shall be collected a penalty at

 

 

 

the rate of one (1%) percent for each month, or fraction of a month, that the installment remains unpaid before being reported to the Township Board for reassessment upon the Township tax roll, and interest shall accrue thereafter in accordance with said Act 188.

 

The assessments made in the special assessment roll are hereby ordered and directed to be collected by the Township Treasurer, and the Township Clerk shall deliver the assessment roll to the Treasurer with his Warrant attached, commanding the Treasurer to collect such assessments in accordance with the direction of the Township Board and said Public Act 188.

 

All resolutions and part of resolutions insofar as they conflict with the provisions of this Resolution be and the same are hereby rescinded.

RESOLUTION

2024-01

 

Motion was made by Commissioner Fiala and seconded WHEREAS; the Barry County Road Commission recognizes the value of non-motorized transportation facilities;

 

WHEREAS, the Barry County Road Commission spends a minimum of 1% of their current MTF distributions on qualifying non-motorized transportation facilities;

 

WHEREAS, the Barry County Road Commission intends to maintain a current 5-year plan in accordance with MCL 247.660k Section 10k of Act 51 of 1951 as amended;

 

NOW THEREFORE BE IT RESOLVED; that the Board of County Road Commissioners for Barry County adopt the 2024 Barry County Road Commission Non-motorized Spending 5-year Plan.
