The regular meeting of the Barry County Road Commission was called to order at the Road Commission’s Board Room at 7:30 A.M. by Chairman Solmes.

 

Members present:  Solmes, Fiala, James, and Managing Director Bradley Lamberg.

 

The agenda for May 16, 2023 was approved.

Randy Buiter spoke to the Board about Graham Road.  There has been an increase in truck traffic with at least 150 trucks a week from one company, Ship Trucks, and then other trucks as well.  He wanted a “No Thru Truck” sign put on Graham Road.  The Board spoke to Mr. Buiter about the issues with stopping trucks going down a primary road that is designed to handle traffic.  Jake Welch, Assistant Managing Director, explained that he has called Ship Trucks and spoke to them about this issue and asked if they could send part of the trucks on a different route.

Motion was made by Commissioners Fiala and seconded to request reimbursement in the amount of $10,000.00 for payment made during the period of July 1, 2022 through June 30, 2023 to a licensed professional engineer employed by this Commission, in accordance with Sec. 12(2) of Act 51.

Motion was made by Commissioner James and seconded to set a Public Hearing for making Little Pine Lake Road a Natural Beauty Road.  The Public hearing to be set for June 6, 2023 or June 20, 2023 contingent to the availability of the Hope Township Hall.

Motion was made by Commissioner Fiala and seconded as to the following,

 

WHEREAS, the Duncan Lake No. 2 Drain (“Drain”) is a county drain located in Barry County, Thornapple Township, Michigan, established under the Michigan Drain Code, Public Act 40 of 1956, as amended (“Drain Code”), and under the jurisdiction of the Drain Commissioner; and  

 

WHEREAS, the Road Commission filed a petition dated August 20, 2019, seeking maintenance and improvement of the Drain; and

 

WHEREAS, a Board of Determination issued an Order of Necessity on December 17, 2019 finding the proposed project (“Drain Project”) necessary and conducive to the public health, convenience, and welfare; and

 

WHEREAS, as part of the Drain Project, the Drain Commissioner intends to repair and replace portions of the Drain within the road right-of-way of Noffke Drive within Thornapple Township; and

 

WHEREAS, Thornapple Township desires to repave portions of the Noffke Drive not included within the Drain Project (the “Road Project”) and has completed the special assessment process for initiating a public improvement project and has established a special assessment district pursuant to the Michigan Public Improvements Act 188 of 1954, as amended; and 

 

WHEREAS, the Road Commission has agreed to construct the Road Project on behalf of Thornapple Township; and

 

WHEREAS, in an effort to minimize disruptions to its residents, reduce duplicative costs and to take advantage of coordination of construction and financing, Thornapple Township and the Drain Commissioner desire to coordinate the Drain Project and the Road Project; and

 

WHEREAS, Section 431 of the Drain Code provides that the Drain Commissioner may contract or make arrangements with public corporations for the purpose of expanding any drainage project provided the costs of such expanded drain project borne by the Drainage District not be in excess of the amounts which can be attributed solely to drainage and flood control; and

 

WHEREAS, the Municipal Partnership Act, Public Act 258 of 2011, as amended, authorizes the parties to enter into a joint endeavor to operate, maintain, repair, service, improve and replace portions of the Drain in the Drainage District; and

 

WHEREAS, pursuant to the authority cited herein, the Parties are willing to coordinate the Drain Project and Road Project upon the terms and conditions set forth in an intergovernmental agreement between the Duncan Lake No. 2 Drain Drainage District, Thornapple Township and Barry County Road Commission, attached as Exhibit A.

 

NOW, THEREFORE BE IT RESOLVED THAT, the Board of Barry County Road Commissioners does approve the intergovernmental agreement between the Duncan Lake No. 2 Drain Drainage District, Thornapple Township and Barry County Road Commission, attached as Exhibit A.

 

 

 

 

BE IT FURTHER RESOLVED THAT the Managing Director is authorized to execute said agreement.

The 2022 Paser Ratings for County Road Commissions for Federal Eligible Centerline Miles was discussed.  Barry County is #2 for the largest percentage of good ranking and #1 for the least percentage of poor ranking.

Motion was made by Commissioner James and seconded that on May 26, 2023 Jake Welch will become the Acting Manager Director and Brad Lamberg will take an advisory role.

Bids were opened for the Caterpillar Excavator on May 11, 2023 – there were no bids.

 

Scott Schantz, Equipment Superintendent, spoke to the Board about the Caterpillar Excavator.  Scott said there was a problem with the wording on the bid documents so the wording was going to be fixed and re-bid.

Moved by J. Ypma, supported by C. VanSyckle, to approve a 4-year contract in the amount of $60,000 per year to the Barry County Road Commission.
