The regular meeting of the Barry County Road Commission was called to order via phone/Zoom meeting (allowed by a Declaration of the State of Emergency for the County of Barry due to COVID 19 adopted March 23, 2021) at 7:30 A.M. by Chairman Fiala.  A Zoom Meeting ID # and telephone number with a meeting ID # was supplied to the Commissioners and the public via our website and posted at our gate at our location so all could participate.

 

Members present:  Fiala, Solmes, Dykstra, and Managing Director Bradley Lamberg. All members are participating via Zoom/telephone and reported they were in Barry County, Michigan

 

The agenda for April 20, 2021 was approved.

BARRY COUNTY ROAD COMMISSION

PETITION FOR MAINTENANCEAND IMPROVEMENT OF A DRAIN

WOLCOTT DRAIN

 

The undersigned is the Board of County Road Commissioners, Barry County, Michigan.  This petition has been duly authorized by the governing body of the Barry County Road Commission and requests that the Wolcott Drain be maintained and improved under the provisions of Chapter 8 of Public Act 40 of 1956, as amended.

 

The Barry County Road Commission has determined that the proposed maintenance and improvement is necessary for the construction or maintenance of Woodland Road to take the surplus water across adjacent lands and understands that it will be liable for an assessment at large for a percentage of the cost of the proposed drain project.

 

The Wolcott drain is located in Woodland Township, Barry County, Michigan.

Motion was made and seconded WHEREAS, the Board of the County Road Commissioners requests the maintenance and improvement of a county drain, located in Woodland Township, Barry County, pursuant to Chapter 8 of Public Act 40 of 1956, as amended; and

 

WHEREAS, Section 327 of the Drain Code authorizes a board of County Road Commissioners to file with the Drain Commissioner a petition for maintenance and improvement of a drain if necessary for the construction or maintenance of any highway to take the surplus water across adjacent lands; and

           

WHEREAS, the Board of County Road Commissioners has determined that the maintenance and improvement of the drain is necessary for the construction or maintenance of Woodland Road to take surplus water across adjacent lands and is also necessary and conducive to the public health, convenience or welfare.

 

NOW, THEREFORE BE IT RESOLVED THAT, the Board of County Road Commissioners does authorize the filing of a petition for maintenance and improvement the drain.

 

BE IT FURTHER RESOLVED THAT the Chairperson is authorized to execute the petition for maintenance and improvement of the drain.

 

 

 

BE IT FURTHER RESOLVED that the Secretary shall forward to the Barry County Drain Commissioner a copy of this Resolution for the petition for maintenance and improvement of the drain

Dave DeHaan from Walker, Fluke, and Sheldon, PLC presented to the Board the 2020 Financial Statements.  Dave DeHaan reported that the Barry County Road Commission received an unmodified opinion or a “clean” opinion for the audit ending December 31, 2020.  This is considered the best or highest level the Road Commission could receive.

 

Motion was made and seconded to accept the 2020 Financial Statements.

Motion was made and seconded to accept the Woodland Township Resolution for Road Work.

WHEREAS:   The excellent maintenance of roads is a matter of price in the township; and

WHEREAS:   The township residents have approved extra voted millage for road maintenance;                           and

WHEREAS:   Proper maintenance of both paved and gravel roads is a benefit to our residents;

NOW THEREFORE BE IT RESOLVED that the Woodland Township Board hereby directs the Barry County Road Commission to proceed with the following road projects in 2021:

 

Dust Control, 2 passes 26% 1000 gal per pass                                   $18,000

Gravel, 9707 CYD @ $7.00                                                               $67,949

Pavement Marking, 7.31 miles (Centerline & Edgeline Painting)      $  5,264

Total                                                                                                    $91,213

WHEREAS, the Township Board is authorized to determine road projects to be completed within the township, and

 

WHEREAS, the Township Board, by the passing of this Resolution, does hereby agree to contract with the Barry County Road Commission for the dust control and gravel expenditures to be completed in 2021 to be paid for from the road mileage monies collected in 2021,

 

 

Rutland Township Resolution Cont.

 

WHEREAS, the Township Board has determined that the State of Michigan pays no property taxes on State Land in the Yankee Springs Recreation Area:

 

WHEREAS, The Township Board has decided that no Township Funds will be expended on the maintenance of any gravel roads that run through the Yankee Springs Recreation Area unless they are inhabited by our residents.

 

NOW THEREFORE BE IT RESOLVED that the Rutland Charter Township Board does hereby authorize the recommended expenditures from the Road Commission for 2021.

 

Dust Control               $15,388.72

Gravel Expense           $22,000.00
