Jake Welch, Director of Operations, was at the meeting to discuss the Lawrence Road, Heath Road, and Guardrail contracts. Federal Aid funding that was to cover these projects might not be available at the time the job is completed; might not be available until the following year or a slim chance that it might not be available at all. It was discussed to continue to monitor the availability of the funding but to go ahead with advance construct contracts for these jobs where the Barry County Road Commission agrees to fund these projects. If the federal funding is not available the Road Commission might pull the projects and not do them this year.

Motion was made and seconded WHEREAS, the Holmes Drain (“Drain”) is a legally established county drain located in the Township of Hastings, County of Barry, and is being petitioned pursuant to the Michigan Drain Code, Public Act 40 of 1956, as amended (the “Drain Code”); and
WHEREAS, Section 327 of the Drain Code authorizes a County Board of Road Commissioners to file a petition with the Drain Commissioner for the construction, maintenance or improvement of a drain, if the drain is necessary for the construction, operation or maintenance of any highway to take the surplus water across adjacent lands; and
WHEREAS, Section 327 of the Drain Code also authorizes a County Board of Road Commissioners to file a petition with the Drain Commissioner for the cleaning out, relocating, widening, deepening, straightening, tiling, extending, improving, constructing, providing structures, adding lands, adding branches and/or relief drains, and/or relocating along a highway or county road of a drain; and
WHEREAS, the construction, maintenance and improvement of the Drain is necessary to address flooding and drainage issues near Center Road approximately 2,700 feet east of Charlton Park Road in Sections 14 and 23 of Hastings Township, Barry County, Michigan and for related flooding upstream or downstream to the contributing watershed.
NOW, THEREFORE BE IT RESOVLED THAT, the Board of County Road Commissioners for the County of Barry does authorize that a Petition be made in the name of the Barry County Road Commission to the Barry County Drain Commissioner for the Holmes Drain.
BE IT FURTHER RESOLVED THAT, the Chairperson is authorized to execute the necessary Petition for cleaning out, relocating, widening, deepening, straightening, tiling, extending, improving, constructing, providing structures, adding lands, adding branches and/or relief drains, and/or relocating along a highway or county road for the Holmes Drain.
BE IT ALSO FURTHER RESOLVED THAT, the Secretary shall forward to the Barry County Drain Commissioner a copy of this Resolution for Petition. This Resolution shall carry the authority, as the governing body for the Barry County Road Commission, and applicable action needed for the Barry County Drain Commissioner to act on the Petition. The Drain Commissioner will appoint a Board of Determination to determine the necessity of the petition and if it is conducive to public health, convenience or welfare.

The undersigned petitioner is the Board of Road Commissioners for Barry County, within which the Holmes Drain Drainage District is laid out and designated in the Township of Hastings, County of Barry, State of Michigan; in which said Petition is being made for the Holmes Drain, having been originally located and established on June 9, 1892.
The petitioner further shows that this petition has been authorized by its governing body and that construction, maintenance or improvement of the Holmes Drain is necessary to take surplus water from a highway or county road across adjacent lands and necessary for the construction, operation or maintenance of a highway or county road. This petition is to address flooding concerns on Center Road, approximately 2,700-feet east of Charlton Park Road and is necessary and conducive to the public health, convenience or welfare.
The undersigned petitioner therefor petitions for the cleaning out, relocating, widening, deepening, straightening, tiling, extending, improving, constructing, providing structures, adding lands, adding branches and/or relief drains, and/or relocating along a highway or county road, which will properly drain the highway/county road and lands in the Drainage District, under the provisions of the Michigan Drain Code, Act No. 40 of the Public Acts of 1956, as amended. The Holmes Drain is located in Sections 13 & 24, Hastings Township, Barry County, Michigan.

Rob Richardson, Equipment Superintendent, and Mechanic Justin Frazer came into the Board Meeting to discuss equipment #901590 2003 Volvo Motor Grader that needs $30,000 in repairs. The current value of the Motor Grader was discussed.
Motion was made and seconded to purchase a new Motor Grader through MiDeal as long as the price of the Motor Grader is in the best interest of the Road Commission.

Dan Price, Sign Crew Leader, came into the meeting to discuss health insurance and that when he was hired in 1957 it was promised to him when he retired and then rescinded in 2003.

Motion was made and seconded to offer an early retirement buyout for employees hired before 1989 based on $120.00 per full year of service from point of retirement to age of 65 with 3 years being the maximum (i.e. 64 year old retiree will get one year). The amount will be paid in lump sum. This offer to be valid through December 31, 2019. The employee shall furnish the Barry County Road Commission a written resignation stating their date of retirement.

Motion was made and seconded to compensate the Superintendent, Shop Superintendent, Director of Operations, and Operations Engineer $20.00 per hour for any hours over 90 hours in a pay period. The additional compensation is due to the high amount hours expected during the 2017 construction season. This is to be in effect from May 29, 2017 until October 27, 2017.
